Claim Drafting Strategy: Where Biotech Prosecution Is Won or Lost
The claims you file determine the scope of your protection. Getting that scope right means balancing breadth against what the science can actually support at the time of filing.
Genus and Species Claims
Most biotech patent strategies involve a hierarchy of claims:
- Genus claims cover a broad class of compounds, methods, or compositions
- Species claims protect specific embodiments within that class as fallback positions
The goal is to hold the genus as long as possible. The risk is overreach. Functional Claiming

Biological Deposit Requirements
When a biotech invention involves biological material that cannot be fully described in words and is not publicly accessible, such as a specific cell line, microorganism, or novel biological sequence, the United States Patent and Trademark Office (USPTO) may require a biological deposit with a recognized depository authority.

Patentable Subject Matter

- Written description: The examiner believes the specification does not show you had the full scope of what you are claiming at the time of filing. Common when a broad genus claim covers many embodiments, but the specification only provides examples for a narrow subset.
- Enablement: The examiner believes a person skilled in the field could not make and use the full scope of the claimed invention without undue experimentation. Common when functional claims cover a broad class of compounds, but the specification does not give enough guidance on how to make every member of that class.
How to respond: Combine claim amendment with a scientific argument, supported by expert declarations where possible. Narrowing to a scope the specification actually supports, while arguing the original scope was warranted, gives you the best chance of keeping meaningful breadth.
Double Patenting
Life sciences companies building portfolios around a single platform often file multiple related applications over time. This creates double patenting risk, where two applications owned by the same entity claim overlapping subject matter. There are two types:
- Statutory double patenting arises when two claims are identical.
- Non-statutory obviousness-type double patenting arises when two claims are not identical, but one would have been obvious in light of the other. The second is far more common in biotech portfolios.
The standard fix: You can file a terminal disclaimer, which ties the expiration of the later patent to the earlier one. This resolves the rejection but shortens the effective life of the later patent. Anticipate double patenting issues when structuring continuation applications so terminal disclaimers do not unnecessarily erode your portfolio term.
